Covidien, a provider of patient monitoring and respiratory care devices, has succeeded in a patent infringement case against Applied Medical Resources.

The US Court of Appeals for the Federal Circuit on August 27, 2013 upheld the lower court’s previous ruling that Covidien’s trocar products do not infringe Applied Medical’s patent.

Earlier in May 2011, Applied Medical filed lawsuit against Covidien in connection with the sale of certain trocar products.

Applied Medical has filed five patent infringement lawsuits since 2000 against Covidien (and its predecessor companies) relating to trocars seals. However, Covidien secured dismissal of all the five infringement suits.

Covidien surgical supplies president Steve Blazejewski noted the company is pleased the Court recognized that Covidien’s trocar products are differentiated from its competitors.

"As we have demonstrated, we will vigorously protect our innovative products, solutions and intellectual property," Blazejewski added.
